1. Acceptance of Terms

By downloading, installing, or using the REFAD mobile application ("the App") or accessing the Refad Tech website at refadtech.com ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Website. These Terms constitute a legally binding agreement between you and Refad Tech ("we", "us", or "our").

2. Eligibility

You must be at least 13 years of age to use the App or Website. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the App.

3. Description of Services

Refad Tech provides the REFAD mobile application, a pilgrim wayfinding and safety platform designed for Hajj and Umrah journeys. The App provides real-time location tracking, indoor and outdoor navigation, geo-fence alerts, SOS emergency response, crowd density monitoring, and communication with campaign supervisors and field support teams. Refad Tech also provides additional technology solutions including strategic planning software (SNext), performance management platforms, and assessment tools (Matrix). The specific features and availability of services may change from time to time without prior notice.

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use in connection with Hajj and Umrah pilgrimage services. You may not:

• Copy, modify, distribute, sell, or lease any part of the App or its content.
• Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law.
• Remove, alter, or obscure any proprietary notices or labels on the App.
• Use the App for any commercial purpose without our written consent.
• Use the App in any manner that could damage, disable, or impair the App or interfere with other users.

5. Account Registration

To use certain features of the App, you may be required to create an account or register through the Nusuk platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account.

6. Acceptable Use

You agree to use the App and Website only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App or Website in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the App, Website, or their systems.
• Transmit any malicious code, viruses, or harmful data.
• Collect or harvest any information from the App or Website without our consent.
• Use the App to send unsolicited communications or spam.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the App in a way that could endanger yourself or other pilgrims.
• Interfere with the proper functioning of the App, including its location tracking and safety features.

7. Location Services and Safety Disclaimers

The App relies on GPS, Bluetooth, Wi-Fi, and cellular signals to provide location-based services. You acknowledge and agree that:

• Location accuracy may vary due to environmental factors, signal interference, device limitations, or network conditions.
• The App is designed as a supplementary safety and navigation aid and is not a substitute for official guidance from Hajj and Umrah authorities, campaign supervisors, or emergency services.
• Indoor positioning (e.g., within the Grand Mosque) relies on Bluetooth Beacons and may have limited accuracy in certain areas.
• The SOS and emergency features depend on network connectivity and device functionality; we do not guarantee emergency response times.
• Background location tracking is used for safety purposes as described in our Privacy Policy, and disabling it may limit the App's safety features.
• We are not responsible for any harm, injury, or loss that may result from reliance on the App's navigation, location, or safety features.

8. Intellectual Property

All content in the App and on the Website — including text, graphics, logos, images, maps, software, algorithms, and design — is the property of Refad Tech or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. User Submissions

When you submit information through the App, Website, contact forms, or other channels, you grant us the right to use that information to respond to your inquiry, provide our services, and ensure your safety during pilgrimage. We will handle your submissions in accordance with our Privacy Policy.

10. Third-Party Services

The App and Website may integrate with or contain links to third-party services, including but not limited to the Nusuk platform, map providers, and analytics services. We do not endorse or assume responsibility for the content, privacy policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies.

11. Account Suspension and Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, if we reasonably believe that you have violated these Terms or if required by law or regulatory authorities. Upon termination, your license to use the App is immediately revoked. You may also delete your account at any time by contacting us at contact@refadtech.com.

12. Disclaimer of Warranties

The App, Website, and all related services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy or completeness of location data, navigation guidance, or any other information provided through the App.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Refad Tech, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the App or Website.
• Any inaccuracy in location data, navigation, or positioning services.
• Any failure or delay in emergency response features.
• Unauthorized access to or alteration of your data.
• Any third-party conduct or content.

In no event shall our total liability exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Refad Tech, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App or Website, your violation of these Terms, or your violation of any rights of a third party.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. We will make reasonable efforts to notify you of material changes through the App or via email. Your continued use of the App or Website after any changes constitutes acceptance of the updated Terms. If you do not agree with the modified Terms, you must stop using the App and delete your account.

16. Modifications to the App

We reserve the right to modify, update, suspend, or discontinue the App or any of its features at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

17. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Refad Tech only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

18. Google Play Store Additional Terms

If you downloaded the App from the Google Play Store, you acknowledge that Google LLC ("Google") has no obligation or liability to you with respect to the App or these Terms. Any claims or disputes related to the App are between you and Refad Tech, not Google.

19. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from or in connection with these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia. Before initiating any formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at contact@refadtech.com.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Refad Tech regarding your use of the App and Website, and supersede any prior agreements.
